We will not be liable if for any reason all or any part of the Website is unavailable at any time or for any period.     These Terms of Use permit you to use the Website for your personal non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Website, except as follows:

  • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
  • You may store files that are automatically cached by your Web browser for display enhancement purposes.
  • You may download one or multiple copies of your Storysite for your personal use, and also for sharing with your family and friends if no financial compensation is involved. You may not download copies of your Storysite for any commercial use.
  • You may print one copy of a reasonable number of pages of the Website for your own personal, non-commercial use, but not for further reproduction, publication, or distribution.
  • If we provide desktop, mobile, or other applications for download, you may download a single copy to your computer or mobile device solely for your own personal, non-commercial use, provided you agree to be bound by our end user license agreement for such applications.
  • If we provide social media features, you may take such actions as are enabled by such features.

    You must not:

  • Modify copies of any materials from this site.
  • Use any illustrations, photographs, video or audio sequences, or any graphics separately from the accompanying text.
  • Delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from this site.

No right, title, or interest whatsoever in or to the Website or any content on the Website is transferred to you, and all rights not expressly granted are reserved by the Company.     The Website allows you to post content, material, personal profiles, and other information to your subpage (collectively “Personal Posts”). All Personal Posts must comply with the Content Standards set out in these Terms of Use.

  • All of your Personal Posts do and will comply with these Terms of Use.

    You understand and acknowledge that you are responsible for any Personal Posts you submit or contribute, and you, not the Company, has fully responsibility for such content, including its legality, reliability, accuracy, and appropriateness. 

    The Company is not responsible or liable to any third party for the content or accuracy of any Personal Posts posted by you or any other user of the Website.

Monitoring and Enforcement; Termination  

    We have the right to:

  • Remove or refuse to post any Personal Posts for any or no reason in our sole discretion.
  • Take any action with respect to any Personal Post that we deem necessary or appropriate in our sole discretion, if we believe that a Personal Post violates the Terms of Use, infringes any intellectual property right or other right of any person or entity, threatens the personal safety of users of the Website or the public, could create liability for the Company, or for any other reason.
  • Disclose your identity or other information about you to any third party who claims that material posted by you violates their rights, including their intellectual property rights or their right to privacy.
  • Take appropriate legal action, including without limitation, referring to law enforcement any illegal, allegedly illegal, or unauthorized use of the Website.
  • Terminate or suspend your access to all or part of the Website for if, in our sole discretion, you have violated these Terms of Use.

    Without limiting the foregoing, we have the right to fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity or other information of anyone posting any materials on or through the Website.     We do not review, approve, verify, or endorse any Personal Posts. The views and opinions expressed in Personal Posts are solely those of the person making the post and do not necessarily reflect the view of the Company. Therefore, we assume no liability or responsibility whatsoever for any Personal Post or for the action or inaction regarding transmissions, communications, or content provided by any user or a third party.

Content Standards  

    These content standards (“Content Standards”) apply to all Personal Posts. Personal Posts must in their entirety comply with all applicable federal, state, local, and international laws and regulations. Without limiting the foregoing, Personal Posts must not:

  • Contain any material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable.
  • Promote sexually explicit or pornographic material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.

  • Promote any illegal activity, or advocate, promote, or assist any unlawful act.
  • Cause annoyance, inconvenience, or needless anxiety or be likely to upset, embarrass, alarm, harass, or annoy any reasonable person.
  • Impersonate any person or misrepresent your identity or affiliation with any person or organization.
  • Involve commercial activities or sales, such as contests, sweepstakes and other sales promotions, barter, or advertising.

Copyright Infringement  

    If you believe that any Personal Posts violate your copyright, please review our Copyright & Trademark Policy for instructions on sending us a notice of copyright or trademark infringement. It is the policy of the Company to terminate the user accounts of repeat infringers.

                                                                                                                                       

Payments  

    All online financial payments for the services provided by the Company through the Website are processed through our shopping cart provider, Paypal and Stripe. If you do not wish to use the Paypal and Stripe shopping cart to use the Website, please contact us regarding other payment options at inquiries@porchswingstories.com.

    You understand and agree that initiating a “chargeback” to your credit card, debit card, or PayPal account for services we have charged to you is a violation of this agreement.

Renewing Your Account

    Your account will renew automatically, on the anniversary of the last renewal, for the length of time of your last renewal. On the renewal date your credit card, debit card, or PayPal account will be automatically charged for the cost of the renewal, at our current rate. If we do not receive payment for the renewal term because your payment method is no longer valid or for some other reason, we may close your account immediately or we may charge you interest on your overdue payment(s).

    You are liable for all unpaid amounts due on your account, even if we close or terminate your account partway through a billing term. You understand that no refunds or reimbursements, in whole or in part, will paid to you at any time. We may use a third-party service to collect overdue or unpaid amounts, and we may charge you for the cost collection, including reasonable attorney’s fees.

    If you dispute a billing charge, you must pay the full amount due by its due date and notify us of the disputed billing charge. If we validate your claim, your account will be credited with the validated amount.

Closing Your Account

    You may close your account at any time as long as your account is in good standing and is paid in full through the closing date. To close your account, please send an e-mail to inquiries@porchswingstories.com.  When you ask us to close your account, we will suspend it for thirty (30) days (the “Suspension Period”), and unless you ask us to reactivate your account during the Suspension Period, we will terminate your account at the end of the Suspension Period.

    When we terminate your account, we will delete all of your Personal Posts (unless we are required by law to keep them). You should regularly backup the content of your Personal Posts since we will not be able to recover your Personal Posts or their content once your account has been terminated.

Any reliance you place on such information is strictly at your own risk. Indemnification

Governing Law and Jurisdiction  

    All matters relating to the Website and these Terms of Use and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Kansas without giving effect to any choice or conflict of law provision or rule (whether of the State of Kansas or any other jurisdiction). 

    Any legal suit, action, or proceeding arising out of, or related to, these Terms of Use or the Website shall be instituted exclusively in the federal courts of the United States in Wyandotte County, Kansas, or the courts of the State of Kansas in Johnson County, Kansas, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms of Use in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

Arbitration  

    At Company’s sole discretion, it may require you to submit any disputes arising from the Policies or the use of the Website, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying Kansas law.

Limitation on Time to File Claims  

    ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR THE WEBSITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OR SUCH CAUSE OF ACTION OR CLAIM SHALL BE PERMANENTLY BARRED.

    No waiver of by the Company of any term or condition set out in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.
